AN appeal against “illegal” road closure notices at the site of the Irton tree has been unsuccessful.
A protest group hoping to save the tree were at Leeds County Court today arguing that road closure notices put up by North Yorkshire County Council were illegal, as they had not given eight weeks’ notice.
A council spokeswoman confirmed that the case has been dismissed and that the notices still stand.
Had it been upheld the tree would have been given an eight-week stay of execution.
Parties on both sides are now waiting for a High Court decision on whether or not the tree can be felled.
