A MAN already subject to a suspended jail sentence for pulling a knife during an argument with a former girlfriend appeared before a court for holding another to the throat of his present partner.

Wayne Tandy, 29, of Royal Terrace, Scarborough, appeared before York Crown Court for sentencing, having previously admitted one charge each of common assault and failing to surrender to bail - both the offences being committed in breach of the 12 month suspended sentenced imposed in 2010 and a community order handed down for a previous breach.

Describing the case as “disturbing”, The Recorder of York, Judge Stephen Ashurst, told Tandy that he was very concerned to hear echoes of the previous case in the new offence.

Matthew Stephenson, prosecuting, told how on February 16 this year, Tandy and his girlfriend had been out drinking, returning home with friends and drinking more alcohol.

He said that Tandy’s mood suddenly changed in the early hours and he placed his hands around her throat and began shouting at her.

Mr Stephenson, who said that the woman could not recall doing anything wrong to provoke the attack, then had a large kitchen knife pressed to her throat so hard by Tandy it cut into her skin.

Police officers called to the scene could see a three inch red mark across the victim’s throat and found her shaking with fear.

For Tandy, Ben Campbell said that his client knew that drink was behind most of his offending and that he had managed, without problems, during the enforced abstinence during 28 days on remand.

Adding that the injury to the woman had been small, Mr Campbell said that the couple were hoping to get back together on his release from prison.

Tandy was jailed for a total of 18 months.
