Man who grew cannabis is ordered to pay back £12,000
A Scarborough man, convicted of growing cannabis plants in his flat, has been ordered to pay over £12,000 at a Proceeds of Crime Act hearing.
Police executed a warrant at the Granville Road flat of James Posner in September, 2011, and found 48 cannabis plants.
The haul, which had an estimated yield potential of £12,000, was discovered in a purposely lined room equipped with sophisticated heating, lighting and ventilation systems.
Posner, now 32, received a suspended prison sentence, with an unpaid work order, supervision and a requirement to comply with a six month drug rehabilitation requirement when he appeared for sentencing before York Crown Court in May, last year.
This week the York court was told that a financial investigation had established that in the past six years Posner had benefited from crime to the tune of £467,563.19 - the figure comprising of income that he could not account for.
The hearing was told that it had been established that Posner had available to him £12,309.19 with which to satisfy a confiscation order and he was given six months to hand over the money.
Posner was warned that if he failed to do so he could face 12 months imprisonment.
The original sentencing hearing was told that Posner admitted paying out £3,450 for the growing equipment, which was then installed by an acquaintance who he did not want to name.
That hearing was told that, as a result of bullying because of him having a Jewish father, Posner had started using cannabis from the age of 14.
The court heard he then developed an addiction which saw him smoking between eight and twelve joints a day.
Posner was said to have decided to grow his own drug to save money because work as a self-employed plumber had all-but dried up.
He had grown a cannabis crop previously in the room, telling the police that, as well as feeding his own habit, he also expected to supply some of the drug to acquaintance as payment for work. Posner said he also saw it as a way of making a bit of extra money.
