28-year-old barmaid Daniella Hirst and her partner were enjoying a night out in Scarborough when CCTV footage caught them indulging in intercourse while waiting for their food order.

Miss Hirst was now been asked to attend her local police station for an interview - because she was partially naked while her boyfriend Craig Smith, 31, remained fully clothed.

She was seen to be undressed from the waist down during the amorous encounter with Craig, a Leeds United fan who was wearing the club's home shirt at the time.

The builder has been told he will not face further action because he is not naked in the clip.

The couple have now spoken to tabloid newspaper The Sun, with Daniella claiming that the police were investigating a public decency offence because her behind was on show.

North Yorkshire Police said she had not attended her interview but that an investigation was underway.

After the incident, an unrepentant Daniella posted a Facebook status saying that people who had not got 'frisky' in a public place were boring.

The couple were celebrating Leeds United's derby win over Sheffield Wednesday when they visited the fast food outlet and began gyrating on the counter.

They also claim to have had sex on a bus, in a van, in a swimming pool and in a field.
