Flamingo Land boss Gordon Gibb has had an assault case against him dismissed by Scarborough magistrates.
Mr Gibb, 36, had been accused of assaulting a man who had allegedly been selling cut-price tickets outside the turnstiles.
The complainant did not turn up for the trial at Scarborough Magistrates Court and magistrates turned down an application by the Crown Prosecution Service to adjourn.
Victoria Shepherd, chairman of the bench, said the complainant and witnesses had known about the case for some time and had been given ample reminders about when to attend.
She said: “We’ve heard what’s gone on and are formally dismissing the case.”
Throughout the proceedings, which relate back to the alleged incident in July, Mr Gibb had maintained that during a scuffle he had acted in self defence.
