Mr M Gere had applied to open the unit selling hot food at 9 Byland Road, which was previously home to Byland News.

However, concerns over the impact that smells and noise from the new business would have on near-neighbours has seen the council’s planners withhold approval.

Whitby Town Council had recommended that the most recent plans be given the green light, but one member of the public and Whitby Civic Society objected.

Planning officers refused the application under delegated powers, stating: “Due to the constraints of the site with residential properties located above/adjacent to the unit, the proposed use and specifically the extraction system would give rise to unacceptable noise, vibration and odour resulting in a detrimental impact upon residential amenity.”
