Bridlington thug weeps as he's jailed

Joshua Lumby, 20, wept in the dock as Judge Jeremy Richardson, QC, told him he deserved prison for trying to dodge his community punishment.

Lumby of Turner Avenue, Bridlington, was given 150-hours of community work in April 2014 for battering his then girlfriend who was 38-weeks pregnant with a girl at the time. Lumby appeared at Hull Crown Court (Monday January 18) after pleading guilty to failing to comply with a community order

The court heard Lumby and his partner were texting each other in breach of the restraining order and met up in a nightclub. The pair saw each other dancing with new partners and words were exchanged. They ended up going back to her before jealousy arose about their previous dancing partners. He pushed her in the face with the flat of his hand causing an injury to her eye and grabbed her around the neck.”

Lumby tried to stop her calling the police, but she pulled a panic alarm. The court heard Lumby has convictions including battery where he spat at his mother because he could not get his way and two offences of possession of cannabis.

Crown barrister Claire Holmes said Lumby had done less than 100 of his 150hours of community punishment. She said he had failed to attend on November 22 and 29th, June 21 October 28 and had been back before the courts a number of times.

Defence barrister Antony Farrell urged the judge not to jail him. He said Lumby had received a threatening text from a fellow offender that he would be “pushed off the bus” if he attended for community work. He said Lumby feared for his life as his brother had been stabbed in broad-daylight a number of years ago and the offender never caught.

Judge Jeremy Richardson, QC, told Lumby: “Enough is enough. The courts have bought into the excuses in the past. You are going to prison for two months. It could be a great deal longer. You are 20 years old and you have a record for violence. You hit your girlfriend in the face. You do not engage with the probation service. You must remember if there is any offending in the future, this will be on your record and it will be straight to prison.
