Scarborough man hit with Criminal Behaviour Order after being drunk and disorderly in public

A 44-year-old Scarborough man appeared before York Magistrates Court on Tuesday December 9, where he was handed a Criminal Behaviour Order (CBO).

On Tuesday, November 4, David Fraser Flinton of Spreight Lane Steps, Scarborough was arrested on Newborough with the junction with Queen Street for being drunk and disorderly. Whilst he was in custody, Flinton also caused damage to the cell he was placed in. Flinton was charged with criminal damage and drunk and disorderly and sent to face Scarborough Magistrates Court on the November 24. After missing his next appearance at court, Flinton was arrested on warrant and was remanded to appear before York Magistrates Court. Flinton’s recent increase of persistent anti-social behaviour and breaching the Public Space Protection Order’s ban on street drinking, highlighted him to Scarborough’s Neighbourhood Policing Team (NPT) who applied for the CBO. PC David Hinchliffe from Scarborough NPT said: “Flinton has a history of public order offences, and despite multi-agency interventions and custodial sentences, Flinton has continued to display poor conduct in public, especially whilst intoxicated. I hope that this order can help Flinton to make positive choices going forward.” Flinton has been ordered not to: • Consume alcohol in any public place other than on licensed premises within the area of Scarborough as defined by the map. • Be in possession of an open container of alcohol in the public place other than on licensed premises within the area of Scarborough as defined by the map. Flinton was provided with the map in court. The order is in place for five years. Flinton pleaded guilty for the charges put to him in court and was also ordered to pay £50 compensation in relation to the criminal damage of the custody cell.
