A fall at work has resulted in a payout of more than £11,000 after he fell from a stepladder and broke his wrist.
Despite the employer initially denying responsibility, the team at Bridge McFarland LLP were able to prove liability to win the damages claim.
The warehouse worker (known as Mr H) was collecting stock from racking in the warehouse and needed to use a ladder to reach what he needed.
However, the stepladders provided were unsuitable for reaching the items on the racking and, as the man reached out to grab the items the stepladders tipped, and he fell about 5 feet, landing heavily on his wrist.
He was taken to hospital where it was confirmed he had broken his wrist and needed surgery.
This left him needing help with daily activities for a couple of months. Thankfully, with the help of regular physiotherapy, he made a good recovery and was ultimately able to return to his job.
“This was a very painful injury which potentially could have had a very significant ongoing impact on Mr H’s use of his right hand, and therefore his future employment,” said Senior Litigation Executive Karl Griffin.
“Initially, the employer’s insurers disputed liability but, as with many such cases, we were able to obtain further information from our client and, after putting forward further arguments, we managed to secure an admission of liability.”
Building a case
The personal injury team got hold of medical reports, including from an orthopaedic consultant, to ensure Mr H’s injuries were fully investigated. Happily, the medical expert confirmed that Mr H’s recovery had been very good and any future symptoms/limitations would be minimal.
We see accidents and injuries of this nature all too often, with employers often unaware that the equipment they are providing for their staff use is simply not appropriate/inadequate. Not all claimants go on to make such a good recovery and many are left dealing with painful and long-lasting symptoms, which can have a big impact on their future employment and earnings potential. This potential future impact is something we will always fully investigate when dealing with any injury claim.
Mr H said he was very happy with the service from Bridge McFarland, who he said kept him updated and involved in the process throughout.
